Pacific Health Systems, Inc. v. Book, 2003

Wrote amicus curiae brief for the United States Supreme Court on behalf of the National Association of Consumer Advocates in case involving arbitration of racketeering claims.

Multistate Sweepstakes Group, 1998-1999

Lead 40+ state investigation of several direct mail sweepstakes marketers, including Publishers Clearing House, American Family Publishers, Readers Digest and others. Coordinated multiple simultaneous multi-party negotiations. Lead group in developing recommendations to Congress on sweepstakes legislation.

Multistate Internet Services Group, 1996-1999

Executive committee member of group of 30+ states investigating computer and Internet related cases and making policy recommendations on Internet related issues. Lead group in formulating policy positions on the UCC2B/UCITA electronic commerce legislation.

HMO Litigation, 1998-1999

Co-counsel in lawsuits against HMO's operated by Aetna, NYLCare, and Humana for deceptive marketing practices and improper use of financial incentives to limit medically necessary care.

America Online (I, II and III), 1996-1998

Lead counsel for group of states that negotiated the first of three settlements with America Online. Executive committee member of group that negotiated the second and third settlements. Obtained $34 million in restitution to consumers, $2.5 million to the states, and significant reforms of America Online's practices, including implementation of standards for notice in online contracting.

GMAC Mortgage Corp. and Fleet Mortgage Corp., 1992-1994

Member of the executive committee of a group of states that negotiated Consent Judgments with two mortgage servicing companies concerning the manner in which they accounted for consumers' escrow funds. These settlements resulted in approximately $140 million in refunds to consumers. In addition, as a result of the group's rulemaking petition to the Department of Housing and Urban Development, the entire industry implemented these changes, resulting in an estimated $3 billion in refunds to consumers over a 3 year period.

Stamps v. Collagen, 1992

Wrote amicus curiae brief of 28 Attorneys General in support of Jennifer Stamps' certiorari petition to the U.S. Supreme Court, seeking reversal of a Fifth Circuit ruling preempting state tort and warranty claims for injuries caused by Class III medical devices.

Mortgage Broker Fee Rulemaking, Department of Housing and Urban Development, 1996-1997

Invited by HUD to participate as committee member in a negotiated rulemaking concerning the status of various kinds of payments to mortgage brokers under the anti-kickback provisions of the Real Estate Settlement Procedures Act.
