Action Letter: Clear Identity Theft From Credit Report

This letter is for phase three of your identify theft plan. You already notified the creditor of the stolen account of the theft, you’ve gathered evidence of the theft, and you’ve found the stolen account reported on your credit report. Use this letter to clear your report. Send it to each credit reporting agency that has included identity theft related information on your report. Be sure to send copies of each dispute to the original creditor as well.

Re: Identity Theft

To Whom It May Concern:

I am writing for your help in correcting an error on my credit report caused by an identity theft. I have enclosed a copy of the report for your review.

On page 3 of my report, the information for my Sears charge card account, No. 9837-2392-21 is wrong. The account is listed as closed with a charged off balance of $787.77. This is incorrect. I was the victim of identity theft and reported that theft to Sears. The thief made 3 charges that were not mine:

4/3/10 Benny’s Auto Repair of Milwaukee $342.56
4/4/10 Big Willie’s House of Kites $121.99
4/4/10 Mississippi Prince Riverboat Casino, Inc. $323.22

I reported these charges to Sears and asked them to close that account to prevent further losses. Although Sears informed me at the time that they would reverse these charges, they have failed to do so. To further substantiate that these charges are not mine, I have enclosed a copy of the police report that I filed when I discovered the theft. I have also enclosed copies of the identity thief’s charge slips that I obtained from Sears as well as copies of charge slips that I signed at about the same time. You can easily see by comparing the signatures that the disputed charge slips were not signed my me.

I am requesting that you correct your report to indicate that this account was paid as agreed and closed at my request.

Please investigate this dispute in accordance with the Fair Credit Reporting Act and provide me with copies of whatever information you obtain in the course of your investigation. When you have completed your investigation, please provide me with a copy of my corrected report.

I have enclosed a sheet listing all of the personal identifying information you should need to conduct your investigation. Please update your records with the information provided, and delete any conflicting information from my report. (Note: Use the Sample of Identifying Information Attachment as an example of the identifying information you should provide).

It is important that you act promptly to correct this error. Last month I applied for a charge card from JC Penney and was turned down because of this error. I am currently shopping for a new car and hope to buy a new home in the next 3 months as well. This error will substantially impair my ability to obtain financing for a car and a home.
